Rochester is the most underwriting-sensitive market we cover. It carries the highest effective property tax rate of any metropolitan area in the United States, and the city adopted one of New York's stricter Good Cause Eviction ordinances in December 2024. Both facts sit directly in a buyer's proforma, and both are routinely missed until diligence.

01 / Property tax The number that breaks Rochester deals

Reassessment is the risk nobody prices.

The Rochester metropolitan area has the highest effective property tax rate in the United States, at 1.82% of market value. Twenty-two of the twenty-five most heavily taxed counties in the country are in Upstate New York, and Monroe County ranks third nationally at the county level.

That figure is not just an operating expense line. It is a transaction risk. When a property sells, the sale price becomes evidence of market value, and an assessor can act on it. A buyer who underwrites to the seller's historical tax bill may be underwriting a number that does not survive the closing.

At a 1.82% effective rate, the arithmetic moves fast. A building assessed well below its sale price can see its tax bill reset by tens of thousands of dollars annually, which at a 6% cap rate removes several hundred thousand dollars of value. This is the most common cause of a late retrade in this market.

What we do about it. We underwrite the post-sale tax exposure before going to market and price the asset accordingly, rather than letting a buyer discover it in week six of diligence and reopen the negotiation.

02 / Regulation Good Cause Eviction in the City of Rochester

Inside the city line, the rules changed.

Rochester City Council adopted Good Cause Eviction on 17 December 2024 by a 7–2 vote. The law applies to rental property inside the city limits. It does not apply in Brighton, Irondequoit, Greece, Henrietta, or anywhere else in Monroe County outside the city.

How Rochester's version works

Coverage. Units renting above 245% of the applicable HUD fair market rent are exempt. Rochester adopted the statutory default of 245%, the lowest tier available, so coverage stops at a lower rent level than in municipalities that adopted 345%.

Small-landlord exemption. Only owners holding no more than one unit anywhere in New York State are exempt — the narrowest version available. This leaves roughly 6,155 units, about 9.2% of the city's rental stock, outside the law.

Rent increases. An increase above the lower of 5% plus local CPI, or 10%, is presumed unreasonable and must be justified by documented increases in operating costs such as taxes or necessary repairs.

For a seller, the practical effect is on the buyer's rent-growth assumption. A buyer who cannot underwrite aggressive mark-to-market on in-place rents will pay less for the same rent roll. Knowing which of your units sit above the exemption threshold, and being able to show it, is worth real money at the negotiating table.

Henrietta carries steady demand from Rochester Institute of Technology. Irondequoit has a lakefront tier that prices differently from its inland stock. Brighton trades on schools and university proximity. Industrial concentrates along the I-390 and I-490 corridors, where asking rents of $6.50 to $6.80 per square foot triple-net sit roughly a third below the national average.

  • Reassessment exposure on sale. The single most important number in a Rochester underwriting, and the one most often left at its historical value until a buyer's lender catches it.
  • Good Cause compliance as a diligence item. Buyers now ask which units sit above the exemption threshold and whether required notices have been given. Sellers who can answer cleanly transact faster.
  • An aging ownership base. A large share of the city's 1950s to 1970s stock is held by owners who have run it for decades and deferred capital. That decision is now colliding with a compliance regime that did not exist when they bought.
  • Deferred capital expenditure meeting buyer scrutiny. Roofs, boilers, and electrical service in stock of this vintage are priced by buyers with far more precision than they were three years ago.
05 / Buyers Who is actually buying

Rochester draws three distinct pools, and they underwrite differently enough that targeting matters more than broadcasting.

  • Local and regional operators who know the submarkets, self-manage, and are least disturbed by the tax and regulatory picture because they already live with it.
  • Out-of-state yield buyers attracted by cash-on-cash returns unavailable in compressed coastal and Sun Belt markets. This pool is the most likely to be surprised by reassessment, and the most likely to retrade if it is not disclosed early.
  • Downstate 1031 capital. New York City owners with large embedded gains are a documented source of replacement capital seeking basis they can service. Upstate multifamily is a natural landing spot.

  • Does Good Cause Eviction apply to my Rochester apartment building?

    It applies if the building is inside the City of Rochester limits. The law was adopted on 17 December 2024 and does not extend to Brighton, Irondequoit, Greece, Henrietta, or other Monroe County suburbs, which have not opted in.

    Within the city, individual units are exempt if they rent above 245% of the applicable Monroe County fair market rent — $3,077 for a one-bedroom and $3,854 for a two-bedroom under the figures DHCR published as current on 4 May 2026.   • Will selling my building trigger a property tax reassessment in Monroe County?

    It can. A sale establishes evidence of market value, and assessors may act on it. This matters more in Rochester than almost anywhere else in the country because the metro carries the highest effective property tax rate in the United States at 1.82% of market value.

    The practical consequence is that a buyer underwriting your historical tax line may be underwriting a number that will not survive the closing. We model post-sale tax exposure before going to market so it is priced in rather than discovered in diligence.

  • What is my Rochester apartment building worth?

    Value in this market is driven less by comparable sales than by what a buyer can actually finance after taxes and after the rent-growth constraint Good Cause imposes inside the city. Two buildings with identical rent rolls can be worth materially different amounts depending on which side of the city line they sit on and where their unit rents fall relative to the exemption threshold.

    Published cap rate figures for individual Upstate markets should be treated carefully — several widely circulated sources publish an identical number for Rochester and Buffalo, which indicates a national average with a city label attached rather than local transaction data.

    The more useful comparison is regulatory. Rochester and Albany have adopted Good Cause Eviction; Syracuse and Buffalo have not. That difference affects the rent-growth assumption a buyer can defend, and therefore pricing, in a way that a headline cap rate does not capture.
